Thi\u0002s Pol\u0002cy expla\u0002ns \u0002n pla\u0002n language how Dreamersland uses personal data on dreamersland.eu, \u0002n the Onl\u0002ne Store, newsletteer and forms, when sell\u0002ng T\u0002ckets and Goods, and dur\u0002ng events. It also covers cook\u0002es and s\u0002m\u0002lar technolog\u0002es.<\/p>\n

\u00a7 1. Controller and contact details<\/p>\n

1. The controller of personal data is DREAMERSLAND spo\u0301\u0142ka z ograniczona\u0328 odpowiedzialnos\u0301cia\u0328, with its registered office in Warsaw at ul. Z\u0307egan\u0301ska 21\/23, 04-713 Warsaw, entered in the National Court Register under KRS number 0000990809, NIP 9522231708, REGON 523041221, referred to below as \u201cDreamersland\u201d or the \u201cController\u201d.<\/p>\n

2. The Controller may be contacted about privacy matters: 1) by email at hello@dreamersland.eu;
\n2) by telephone on +48 888 802 611;
\n3) in writing at its registered office address.<\/p>\n

3. Dreamersland has not appointed a Data Protection Officer. It is not required to name a person to this role merely because it processes data in the course of its business. If a Data Protection Officer is appointed, their contact details will be published in this Policy and notified to the competent authority where required by law.<\/p>\n

\u00a7 2. Scope of the Policy<\/p>\n

1. This Policy applies to data processed in connection with:
\n1) the use of dreamersland.eu and its language versions;
\n2) user accounts, the basket, Orders and operation of the WooCommerce Online Store;
\n3) the sale and delivery of Tickets, access to events and the sale of Goods through the Atelier; 4) PayU and Przelewy24 payments;
\n5) the newsletter managed through MailerLite;
\n6) forms and messages, including Partner submissions;
\n7) the planned Dream Scholarship Programme when it opens;
\n8) services for Participants, children and people using an entitlement to a reduction;
\n9) complaints, withdrawals, refunds and legal claims;
\n10) analytics, advertising, cookie consents and embedded content;
\n11) event documentation and safety.<\/p>\n

2. \u201cGDPR\u201d means Regulation (EU) 2016\/679 of the European Parliament and of the Council. \u201cPKE\u201d means the Polish Act of 12 July 2024, Electronic Communications Law.<\/p>\n

\u00a7 3. Data protection principles<\/p>\n

1. Dreamersland processes data lawfully, fairly and transparently, for specified purposes and only to the extent necessary.<\/p>\n

2. Data is retained no longer than required by the purpose, the law or the need to establish, exercise or defend legal claims.<\/p>\n

3. Access is limited to people who need the data for their work and are authorised or bound by confidentiality.<\/p>\n

4. Dreamersland applies technical and organisational measures appropriate to the risk, including access restrictions, encrypted transmission, updates, backups and incident response procedures.<\/p>\n

5. Dreamersland does not sell personal data. It does not provide sponsors or partners with Participant data for their own use.<\/p>\n<\/div>\n

\u00a7 4. Website, logs and security<\/p>\n

1. The server and security systems may record the IP address, date and time of a request, the page visited, the referring page, browser type, device, operating system and security-related events.<\/p>\n

2. The data is used to display the Website correctly, diagnose faults, prevent abuse, ensure security and protect legal claims. The basis is performance of a service requested by the user under Article 6(1)(b) GDPR or the Controller\u2019s legitimate interests under Article 6(1)(f) GDPR.<\/p>\n

3. Logs are retained for the period configured by the hosting provider and security systems, no longer than required for ordinary administration. They may be kept longer where they concern an incident, legal obligation or claim.<\/p>\n

\u00a7 5. Account, Orders, Tickets and Goods<\/p>\n

1. When an account is created or an Order is placed, Dreamersland may process the customer\u2019s first name and surname, company, tax identification number, billing and delivery address, email address, telephone number, login data, Order contents and history, product identifier, price, currency, payment status, invoice details, delivery method and correspondence.<\/p>\n

2. The data is needed to take steps before entering into an agreement and to enter into and perform it under Article 6(1)(b) GDPR. Accounting and tax data is processed under Article 6(1)(c) GDPR. The prevention of abuse and protection of claims are based on Article 6(1)(f) GDPR.<\/p>\n

3. Providing data marked as mandatory is voluntary, but necessary to create an account, place an Order or perform the agreement.<\/p>\n

4. A Ticket is delivered to the email address or account provided. The system records the Ticket code, its status and its first validation to perform the agreement, manage admission and prevent repeated use of the code.<\/p>\n

5. Where Goods are shipped, the data needed for delivery is received by the selected carrier or collection point operator.<\/p>\n

\u00a7 6. PayU and Przelewy24 payments<\/p>\n

1. For an electronic payment, the data needed for the transaction is received by the selected operator: 1) PayU S.A., with its registered office in Poznan\u0301;
\n2) PayPro S.A., with its registered office in Poznan\u0301, the operator of Przelewy24.<\/p>\n

2. The data may include the transaction identifier and amount, currency, payment status, contact details, Order information and technical data required for payment security.<\/p>\n

3. The operator may act as a separate controller to provide the payment service, prevent fraud and perform its own legal obligations. Details are set out in its privacy notice.<\/p>\n

4. Dreamersland does not receive or retain the full card number, security code or online banking login details.<\/p>\n

\u00a7 7. Participants and children<\/p>\n

1. A child\u2019s Ticket is purchased by an adult. Dreamersland does not require a child to create an account and does not direct the newsletter to children.<\/p>\n

2. Unless required to perform the agreement or ensure safety, a child\u2019s first name, surname and full date of birth are not collected when a purchase is made. The system may record the Ticket category and the adult Purchaser\u2019s details.<\/p>\n

3. Age may be checked at the entrance by visually inspecting a document. The document is not copied, scanned or photographed.<\/p>\n

4. A child who has not reached the age of 10 when the Festival opens attends free of charge with their own Ticket and under the care of an adult holding a valid Ticket.<\/p>\n

5. Data needed in an emergency or to find a guardian is processed only to the extent necessary to protect the vital interests of the child or another person under Article 6(1)(d) GDPR or to perform a legal obligation.<\/p>\n

\u00a7 8. Disability-related eligibility checks<\/p>\n

1. Information about disability is health data and receives special protection under Article 9 GDPR.<\/p>\n<\/div>\n

2. At the entrance, an authorised person only visually inspects a valid document confirming entitlement to the reduction. The document is not copied, scanned or photographed. Dreamersland does not record the diagnosis, type, code or degree of disability, document number or its contents.<\/p>\n

3. After the check, staff may record only the neutral result \u201cTicket cleared for validation\u201d, without stating the reason. If the document is not presented or does not confirm entitlement, the Participant may pay the difference in accordance with the Ticket terms.<\/p>\n

4. Ordinary data required to perform the agreement for a Reduced-Price Ticket is processed under Article 6(1)(b) GDPR. Selecting a Ticket with a 50% reduction may reveal health information. Before an Order is placed for such a Ticket, Dreamersland obtains separate, explicit consent to process that information and to carry out the later visual verification of the document at admission under Article 9(2)(a) GDPR. Consent is voluntary. If it is refused or withdrawn, the reduction cannot be confirmed, but the Participant may select a Standard Ticket or pay the difference in accordance with the Ticket terms. Withdrawal does not affect the lawfulness of processing carried out before it.<\/p>\n

5. Access to the result of the check is limited to people who need it for admission, settlement or the defence of claims. The result is erased when these purposes and the required settlement periods have ended.<\/p>\n

\u00a7 9. MailerLite newsletter<\/p>\n

1. The newsletter is sent only to people who have voluntarily given consent. Consent is not a condition of purchase.<\/p>\n

2. Dreamersland processes the email address and, if the form so provides, the first name, date and source of subscription, information about the giving or withdrawal of consent and data required to demonstrate its wording.<\/p>\n

3. The basis is consent under Article 6(1)(a) GDPR and the direct marketing consent required by Article 398 PKE.<\/p>\n

4. The newsletter is managed by the provider of the MailerLite platform under the current agreement for Dreamersland\u2019s account.<\/p>\n

5. Where the subscription form explains this, MailerLite also records message opens, clicks, device information, the IP address and campaign performance. This data is used to analyse the newsletter on the basis of consent.<\/p>\n

6. Consent may be withdrawn through the unsubscribe link in the message or by contacting Dreamersland. Data required for sending is then erased, while a minimal record of consent and its withdrawal may be retained until the limitation period for claims has expired under Article 6(1)(f) GDPR.<\/p>\n

\u00a7 10. Messages, forms and Partner submissions<\/p>\n

1. When a person contacts Dreamersland, it processes the data provided in the message, in particular contact details, correspondence, the entity name and information about the matter.<\/p>\n

2. The basis is Article 6(1)(b) GDPR where the contact concerns an agreement, Article 6(1)(c) GDPR where it follows from a legal obligation, or Article 6(1)(f) GDPR where the purpose is to respond, assess a proposal, manage a relationship or protect claims.<\/p>\n

3. Partner submissions are delivered to Dreamersland\u2019s email inbox. Access is limited to people authorised to assess proposals and conduct discussions about cooperation.<\/p>\n

4. Data is retained until the matter is concluded. If the discussion results in a legal relationship, it may be kept until the limitation period for claims has expired. A proposal that is not pursued is erased after the periodic assessment of proposals has ended, unless the person has agreed to further contact or another legal basis applies.<\/p>\n

5. Special category data, identity documents or information about another person should not be sent unless the form expressly requests it.<\/p>\n

\u00a7 11. Dream Scholarship Programme<\/p>\n

1. Applications for the Dream Scholarship Programme are not currently open. Dreamersland does not accept applications merely because the Website contains information about the planned programme.<\/p>\n

2. When the programme opens, an application may be submitted by an adult holding the required Ticket. Eligibility will be checked using the minimum data, for example the Order or Ticket number.<\/p>\n

3. Separate programme rules and a data processing notice will be published before the form opens, covering the scope of the application, assessment criteria, recipients and retention periods.<\/p>\n<\/div>\n

4. Publication of a selected person\u2019s story, photograph or likeness requires a separate legal basis and prior information.<\/p>\n

\u00a7 12. Complaints, withdrawals and claims<\/p>\n

1. Dreamersland may process contact details, the Order number, the request, evidence, correspondence history, data needed for settlement and the outcome of the matter.<\/p>\n

2. The basis is performance of the agreement under Article 6(1)(b) GDPR, legal obligations under Article 6(1)(c) GDPR, and the establishment, exercise or defence of legal claims under Article 6(1)(f) GDPR.<\/p>\n

3. The data is retained until the matter is concluded and then until the relevant limitation period expires or the proceedings end.<\/p>\n

\u00a7 13. Photographs, recordings and security monitoring<\/p>\n

1. Dreamersland may document the Festival through photographs and recordings for information, documentary, archival and promotional purposes connected with Dreamersland\u2019s cultural activities.<\/p>\n

2. The image of a person who is merely an incidental element of a larger whole, such as a gathering, public event, landscape, stage or wide view of the Site, may be disseminated under Article 81 of the Polish Copyright and Related Rights Act. The basis for processing is Article 6(1)(f) GDPR, and the legitimate interests are documenting, archiving and providing information about the Festival and promoting Dreamersland\u2019s cultural activities.<\/p>\n

3. Such material may be used by DREAMERSLAND sp. z o.o. in official channels, including the Website, Online Store, newsletter, social media, video channels, Dreamersland\u2019s own advertising for Tickets, events and Atelier Goods, and in print, press, archival and reporting materials.<\/p>\n

4. Sponsors and partners do not receive material containing Participant images or other Participant data for their own use.<\/p>\n

5. A portrait, close-up, posed image, statement or advertising material in which an identifiable person is the main subject requires a separate legal basis. Where consent or permission is needed, it is obtained in advance. Attendance at the Festival does not itself amount to such consent.<\/p>\n

6. In the case of a child, a guardian\u2019s consent to attendance does not replace the consent or permission needed to use an individual image of the child.<\/p>\n

7. Image and sound monitoring for the safety of the Mass Event is conducted under the Polish Act on the Safety of Mass Events. Material that is not evidence is destroyed within the period required by that Act, generally no earlier than 30 days and no later than 90 days after the Mass Event has ended.<\/p>\n

\u00a7 14. Cookies and similar technologies<\/p>\n

1. The Website uses cookies, browser local storage, pixels, identifiers, tags and similar technologies.<\/p>\n

2. Strictly necessary technologies operate to the extent required to transmit a communication or provide a service expressly requested by the user, in accordance with Article 399(3) PKE. They support, among other things, security, the session, the WooCommerce basket and checkout, the account, language and the recording of the user\u2019s choice in the CookieScript consent panel.<\/p>\n

3. Analytics, advertising and other non-essential technologies are activated only after voluntary consent through the CookieScript panel under Article 399 PKE and Article 6(1)(a) GDPR.<\/p>\n

4. The tools used may include:<\/p>\n

1) Google Tag Manager for tag management;<\/p>\n

2) Google Analytics for statistics;<\/p>\n

3) Google Ads for campaign and conversion measurement;<\/p>\n

4) Meta Pixel for campaign and advertising measurement;<\/p>\n

5) YouTube in privacy-enhanced mode through the youtube-nocookie.com domain, loaded only after the user consents;<\/p>\n

6) WooCommerce attribution functions where active and requiring consent.<\/p>\n

5. A user may reject all non-essential categories and withdraw consent as easily as it was given. Refusing consent does not prevent browsing, use of the basket or purchase, but may restrict a function that depends on external technology.<\/p>\n<\/div>\n

6. The current CookieScript panel shows the detailed list of cookies, providers, purposes and lifetimes. Browser settings may additionally restrict cookies, but do not replace the consent panel on the Website.<\/p>\n

\u00a7 15. Recipients of data<\/p>\n

1. Data may be received, solely to the extent required to perform a task, by: 1) providers of hosting, email, domain, backup and IT support services; 2) Website and Online Store software providers;
\n3) PayU and PayPro in connection with payments;<\/p>\n

4) the provider of the MailerLite platform in connection with the newsletter;
\n5) the provider of CookieScript in connection with consent management;
\n6) providers of Google and Meta services after consent to the relevant cookie category; 7) carriers and collection point operators selected for Goods;
\n8) providers of accounting, legal, audit and insurance services;
\n9) authorised personnel and entities supporting admission and event safety;
\n10) photographers, film crews and other contractors acting solely for Dreamersland; 11) public authorities and services where required by law.<\/p>\n

2. Not every recipient acts as a processor. A payment operator or tool provider may be a separate controller to the extent provided for by applicable law and its own terms.<\/p>\n

\u00a7 16. Transfers outside the EEA<\/p>\n

1. Some providers or their subcontractors may process data outside the European Economic Area.<\/p>\n

2. A transfer takes place only on a basis provided by Chapter V GDPR, in particular a European Commission adequacy decision, the EU\u2013US Data Privacy Framework for a certified recipient, or standard contractual clauses together with supplementary safeguards where required.<\/p>\n

3. Information about the basis applying to a particular provider and how to obtain a copy of the safeguards is available from hello@dreamersland.eu.<\/p>\n

\u00a7 17. Retention periods<\/p>\n

1. The period depends on the purpose and legal basis:<\/p>\n

1) an account is maintained until it is deleted, with transaction and claims data retained where required;<\/p>\n

2) Order and agreement data is retained for the performance period, mandatory tax and accounting retention periods, and the limitation period for claims;<\/p>\n

3) newsletter data is retained until the person unsubscribes or withdraws consent, while a minimal record of consent is kept until the limitation period for claims has expired;<\/p>\n

4) correspondence is retained until the matter is concluded and, where a legal relationship arose, until the limitation period for claims has expired;<\/p>\n

5) cookie consents are retained for the period needed to demonstrate compliance, in accordance with the current panel configuration;<\/p>\n

6) analytics and advertising data is retained until consent is withdrawn or a shorter period configured in the tool expires;<\/p>\n

7) Mass Event security material is retained in accordance with \u00a7 13 paragraph 7;<\/p>\n

8) photographic and film documentation is retained for the time required by the purpose for which it was created and for as long as it retains justified documentary, archival or cultural value; the usefulness and legal basis for continued retention are reviewed periodically;<\/p>\n

9) Dream Scholarship Programme data will be retained in accordance with the notice published before the programme opens.<\/p>\n

2. Data is erased earlier if the purpose has ended and there is no other basis for processing. It may be retained longer where required by law, a competent authority, the preservation of evidence or pending proceedings.<\/p>\n<\/div>\n

\u00a7 18. Individual rights<\/p>\n

1. Under the conditions set out in the GDPR, a person has the right to access their data, receive a copy, rectify or erase it, restrict processing, obtain data portability, object and withdraw consent.<\/p>\n

2. An objection to direct marketing is effective without giving reasons. An objection to processing based on legitimate interests is considered in the light of the person\u2019s particular situation.<\/p>\n

3. A request may be sent to hello@dreamersland.eu. Dreamersland may ask only for information needed to confirm identity.<\/p>\n

4. The right to erasure is not absolute. Data may be retained where required to comply with a legal obligation, to exercise the right to freedom of expression and information, or to establish, exercise or defend legal claims.<\/p>\n

5. Where possible, a request concerning a photograph or recording should identify the material, the place of publication and the person concerned. Dreamersland considers a request for erasure or an objection under Articles 17 and 21 GDPR and responds within the periods set out in the GDPR.<\/p>\n

6. A person may lodge a complaint with the President of the Personal Data Protection Office in Poland.<\/p>\n

\u00a7 19. Profiling and changes to the Policy<\/p>\n

1. Dreamersland does not make decisions concerning users based solely on automated processing which produce legal effects or similarly significantly affect them.<\/p>\n

2. After consent is given, analytics and advertising tools may measure conversions, create audiences or adapt advertising based on activity on the Website.<\/p>\n

3. This Policy may be changed when processes, providers, tools, the law or the requirements of a public authority change. The current version takes effect on the date it is published.<\/p>\n

4. If an amendment materially affects individuals, Dreamersland provides notice in an appropriate manner. Where a new purpose requires consent, it is obtained before processing begins.<\/p>\n

5. Archived versions are retained with their effective dates so that the version applying to a particular Order can be retrieved.<\/p>\n<\/div>\n
