§ 1. Seller and scope of these Terms

1. The Dreamersland Website and Online Store are operated by DREAMERSLAND spółka z ograniczoną odpowiedzialnością, with its registered office in Warsaw at ul. Żegańska 21/23, 04-713 Warsaw, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0000990809, tax identification number NIP 9522231708 and statistical number REGON 523041221, referred to below as the “Seller”. In relation to free electronic services, the Seller is also the service provider.

2. The Seller can be contacted by email at hello@dreamersland.eu, by telephone on +48 888 802 611, or in writing at its registered office.

3. These Terms govern the use of the website available at https://dreamersland.eu and https://www.dreamersland.eu and its subpages, referred to below as the “Website”, the free services provided electronically, and the operation of the Online Store, placing Orders, payments, delivery of Tickets and Goods, withdrawal from a Contract and complaints.

4. These Terms are made available free of charge on the Website in a way that enables them to be obtained, reproduced, stored and printed. Before entering into a contract that requires an active action by the User, including creating an account, sending a Form, subscribing to the Newsletter or placing an Order, the User is given the opportunity to read these Terms. In the case of a Ticket, the Purchaser is also given access to the applicable event regulations.

5. A Purchaser buying a Ticket for another person should provide that person with the documents governing participation in the event.

6. Participation in an event is governed by the relevant event regulations and, where applicable, the mass event regulations. The processing of personal data is described in the Dreamersland Privacy and Cookies Policy.

§ 2. Definitions

1. Ticket means electronic confirmation of one person’s entitlement to enter the Festival, a concert or another event described in the Offer.

2. Standard Ticket means a Ticket for one person covering the whole Festival Period and the services listed in § 5(4).

3. Reduced-Price Ticket means a Ticket offered at a reduced price where the eligibility criterion described in these Terms and the Offer is met.

4. Additional Access Ticket means a service for the holder of a valid Ticket covering the whole Festival, entitling that person only to enter and remain on the Festival Site outside the Festival Period, during the hours stated in the Offer.

5. Festival means Dreamersland 2027, held at Zaścianek Babie Lato, Ziemiary 56, 99-417 Bolimów, Poland.

6. Form means a contact form, the Partners form, the Order form or another form made available on the Website.

7. Consumer means a natural person entering into a Contract for purposes that are not directly related to that person’s trade, business or profession.

8. Purchaser means a person or entity using the Online Store or entering into a Contract with the Seller.

9. Newsletter means the free service of sending information about Dreamersland, events, the programme, Tickets, the Atelier, collaborations and other news, including commercial information where the User has given the required consent.

10. Offer means the description of a product or service, its scope, price, availability and conditions displayed in the Online Store before an Order is placed.

11. Optional Add-ons means services offered separately, such as parking, glamping or a camper pitch, which are not part of a Standard Ticket unless the Offer expressly states otherwise.

12. Organiser means DREAMERSLAND sp. z o.o. as the organiser of the Festival and, in the case of another event, the entity stated in the Offer.

13. Patron Package means a single Offer comprising a Ticket and the physical Artefacts stated in the description of the Patron or Honorary Patron Package.

14. Entrepreneur with Consumer Rights means a natural person entering into a Contract directly related to their business activity where, having regard in particular to the scope of business activity recorded for that person in the Polish Central Register and Information on Economic Activity, the Contract is not of a professional nature for that person.

15. Ticket Release means a limited number of Tickets offered on the terms and at the price published in the Online Store.

16. Dreamersland Balance means a value recorded in the currency of the original payment, created following the Purchaser’s active choice and intended for the purchase of one or more Tickets for selected Dreamersland events from available exchange pools.

17. Online Store means the online store operating on the Website, including the Atelier section through which Goods are sold.

18. Festival Site means the grounds of Zaścianek Babie Lato and the zones made available to Participants in accordance with the Organiser’s regulations and signs.

19. Festival Period means the period from 16:00 on 14 July 2027 until 14:00 on 18 July 2027.
20. Goods means movable property offered in the Online Store, in particular a physical product from the Atelier,

including a Dreamersland Artefact.

21. Durable Medium means a method of storing information that allows it to be accessed for an appropriate period and reproduced unchanged, including an email or PDF document.

22. Participant means a person using a Ticket or taking part in an event.
23. Contract means a contract entered into remotely through the Online Store, and Order means the Purchaser’s

declaration intended to enter into that Contract.

24. User means a person or entity using the Website or an electronic service.

25. Force Majeure means an extraordinary external event beyond the reasonable control of the Seller or the Organiser, the effects of which could not have been prevented despite due care and which directly makes performance of the event in the agreed manner impossible, unlawful or objectively unsafe.

§ 3. Website and services provided electronically

1. The Seller provides, free of charge:

1) access to the Website’s public content, functions and Offers;

2) use of the basket and Order form;

3) use of a Purchaser account, where this function is available;

4) the ability to send a message through the contact form;

5) the ability to submit a collaboration proposal through the Partners form;

6) subscription to and receipt of the Newsletter;

7) once the programme has opened, the ability to submit an application for the Dream Scholarship under the rules made available before the application is sent.

2. Use of the Website requires a device with Internet access and an up-to-date browser that supports encrypted connections. An active email address is required to use the Forms and Newsletter and to place Orders. The basket requires support for cookies that are essential to its operation.

3. Use of the Internet involves risks such as malicious software, phishing and impersonation. Users should protect their devices and email accounts and check the website address and message sender. The Seller does not ask for passwords to email, online banking or other services in an ordinary email or Form.

4. A contract for access to the Website’s public content is entered into when the User opens the Website and ends when the User leaves it. A contract for using the basket or a Form lasts from the time the User begins using it until use ends, the Form is submitted or abandoned. An account contract continues until the Purchaser deletes the account or the Seller lawfully discontinues the service. The Purchaser may delete the account free of charge in the account settings or by emailing hello@dreamersland.eu. Deletion does not affect the performance of Orders already placed or rights arising from Contracts already entered into. The Seller may discontinue an account because of a material or repeated breach of these Terms, unlawful use of the account or a security risk. As a rule, the Seller will first require the breach to stop and allow a reasonable period for compliance. It may act immediately where required by law or where there is an urgent security risk, and will provide notice on a Durable Medium unless the law prohibits it from doing so.

5. A Newsletter contract is entered into for an indefinite period following a valid subscription. Subscription is voluntary and the User may unsubscribe at any time, free of charge and without giving a reason, by using the unsubscribe link in a message or contacting hello@dreamersland.eu. The Newsletter is operated using the MailerLite platform and may contain commercial information and direct marketing where the User has given the required consent.

6. The contact form is used for enquiries. The Partners form is used for proposals relating to collaboration, partnership, sponsorship or patronage. Submissions are delivered to an email inbox operated by the Seller. Sending a submission does not guarantee a reply, acceptance of a proposal, a favourable decision or the conclusion of another contract.

7. A submission is not confidential unless the parties have agreed otherwise in advance. Rights in submitted materials remain with the relevant rights holder. The User permits the Seller to receive, store, display internally and evaluate the materials solely for the purpose of handling the submission. Public use requires a separate legal basis.

8. Applications for the Dream Scholarship will be accepted only after the programme has opened and its separate rules have been published. The programme will be intended for adults who meet the valid-Ticket requirement stated in those rules. A message sent outside the designated Form and application period is not an application.

9. The User must use the Website lawfully, for its intended purpose and with respect for the rights of others. Users must not send unlawful content, content that infringes another person’s rights, privacy or dignity, is fraudulent, contains malicious code or constitutes unsolicited commercial communication. Users must not interfere with the Website, circumvent its safeguards or obtain unauthorised access to data.

10. Information entered in a Form should be truthful, current and necessary for handling the matter. Special category data or other unnecessary data should not be provided unless the Seller expressly requests it and provides the appropriate information. A person sending data or materials concerning another person must have the right to provide them.

11. Some functions require cookies that are essential for their operation. Other technologies are activated in accordance with the User’s choices, as described in the Dreamersland Privacy and Cookies Policy.

12. The Website may contain links and external materials, such as video players or social media content. Activating them may establish a connection with the external provider’s system and be subject to its rules. The presence of a link does not mean that the Seller endorses all content or activities of that provider.

13. A complaint concerning an electronic service or the Website may be sent to hello@dreamersland.eu or submitted in writing to the Seller’s registered office. It is helpful to provide contact details for the reply, the type of service, the date, a description of the problem and the requested solution. The Seller will reply without undue delay and no later than 14 days after receiving the complaint.

§ 4. Placing an Order and entering into a Contract

1. Information in the Online Store is an invitation to enter into a Contract unless a particular Offer expressly states otherwise.

2. The Purchaser selects the product and variant, checks its scope, price and any reduction conditions, provides the necessary information, selects delivery and payment, reviews the relevant terms, corrects any errors and then places the Order using a button that clearly states that payment is required.

3. Immediately before the Order is placed, the Online Store displays the selected products or services and their main characteristics, the total amount payable including tax, delivery costs and all mandatory charges, the date or period of performance, and whether a right to withdraw applies. Voluntary add-ons are charged separately only if the Purchaser selects them.

4. Placing an Order constitutes an offer by the Purchaser. The Contract is entered into when the Purchaser receives a message from the Seller expressly confirming acceptance of the Order for fulfilment. A technical acknowledgement of receipt alone does not amount to acceptance where the message expressly states this.

5. Confirmation of the Contract includes at least the Order number, selected products, total amount, payment and delivery methods and the required documents on a Durable Medium.

6. If payment is not successfully completed, the Seller may request payment within an additional period and then reject the Order or end the Contract in accordance with the law.

7. The Seller may refuse an Order where the product is unavailable, the information provided does not enable the Contract to be performed, the Order is unlawful or there is a reasonable suspicion of misuse. The Seller will inform the Purchaser and refund any payment received.

§ 5. Tickets, Ticket Releases and reductions

1. Tickets may be offered in successive, limited Ticket Releases. The conditions, availability and price of each Ticket Release are published in the Online Store before purchase. Launching a later Ticket Release does not change the terms of a Contract already entered into.

2. The product price includes tax where applicable. Every mandatory charge and the total amount payable are shown before an Order is placed. Delivery costs, Goods, Additional Access Tickets and Optional Add-ons are not part of the Standard Ticket and are charged separately unless the Offer expressly states otherwise. Where the Seller announces a price reduction, it also gives the lowest-price information required by applicable law.

3. Age eligibility is determined at the opening of the Festival, at 16:00 on 14 July 2027. A document confirming any other eligibility must be valid when it is checked at admission.

4. A Standard Ticket includes:
1) participation by one person throughout the Festival Period;
2) access to the Festival programme, subject to permitted changes described in the event regulations; 3) use of the sanitary facilities made available on the Festival Site.

5. The Organiser makes a generally accessible, unallocated Campsite available to Participants at no additional charge so that they may pitch their own tents. The Campsite is provided as part of the organisation of the Festival Site and is not included in the price or scope of the Ticket. It does not include a reserved pitch, a tent, equipment, bedding, electricity, food, transport or on-site support services. Detailed rules are set out in the Dreamersland 2027 Festival Terms.

6. A child who has not reached the age of 10 at the time stated in paragraph 3 may participate free of charge on the basis of their own registration ticket and under the care of an adult holding a valid Ticket.

7. A separate child ticket may be purchased, on the terms stated in the Offer, for a person who has reached the age of 10 but has not reached the age of 13.

8. A Reduced-Price Ticket with a 30% reduction from the price of a Standard Ticket in the current Ticket Release is available for a person who has reached the age of 13 but has not reached the age of 25.

9. A Reduced-Price Ticket with a 50% reduction from the price of a Standard Ticket in the current Ticket Release is available for a person holding a valid disability certificate or another valid official document confirming that eligibility.

10. A document confirming age or another entitlement is checked on first entry. A disability certificate is checked visually only. The Organiser does not make a copy, scan or photograph of it and does not record the diagnosis, type, code, degree of disability or document number. Staff may record only that the Ticket was cleared for validation, without stating the reason.

11. If the Participant does not present a valid document, they may pay at the entrance the difference up to the price of a Standard Ticket in the Ticket Release in which the Ticket was purchased. The Organiser may refuse entry until the additional payment is made or eligibility is confirmed.

12. If one person meets more than one reduction criterion, the method of applying those reductions must be stated clearly in the Offer before purchase.

13. A Patron Package is one Offer and has one total price. It comprises a Ticket and the physical Artefacts described in the Offer, including a special dedication or an additional adventure thread dedicated to Patrons in the Journal and Cards where the Offer provides for them. It does not include an Additional Access Ticket. Each part of the Package retains the rights applicable to Tickets and Goods. The absence of a separate price for the Artefacts does not remove the Purchaser’s rights relating to Goods. Where settlement concerns only part of the Package, in particular because of a valid withdrawal relating to Goods, a lack of conformity of Goods, a material change or non-performance of the event, the amount attributable to that part is determined proportionately by reference to the ordinary standalone prices of the components on the purchase date or, where a component was not offered separately, its documented market value on that date. The total values attributed to the components must not exceed the total Package price. The exception for an item made to the Purchaser’s specifications or serving their individual needs applies only to the Artefact that was actually personalised, not to the Ticket or any remaining standard Goods.

§ 6. Payments and sales documents

1. The Online Store may display prices in PLN, EUR or USD. The payment currency and total amount are stated unambiguously before an Order is placed. An indicative conversion does not change the settlement currency.

2. Available payment methods are displayed before the Order is placed. Electronic payments may be processed by PayU S.A. or PayPro S.A., the operator of Przelewy24, in accordance with the Purchaser’s choice.

3. The Seller does not retain full payment card details. Information required to process a transaction may be provided to the selected payment operator.

4. The Purchaser bears only the costs clearly displayed before the Order is placed. Paid add-ons are not selected by default.

5. A Purchaser requesting an invoice provides the necessary information when placing the Order. An invoice may be sent electronically where permitted by law.

6. A refund is made using the same payment method as the original payment unless the Purchaser agrees to another method that does not cause them to incur any costs.

§ 7. Delivery and use of Tickets

1. A Ticket is sent to the email address stated in the Order or made available in the account after the Contract has been entered into and payment has been completed, unless the Offer states another method.

2. The Purchaser should check the Ticket details and confirm that the Ticket can be opened. If no Ticket is received after payment, the Purchaser should contact hello@dreamersland.eu and provide the Order number.

3. Until first successful validation, a Ticket is a bearer Ticket. The first person to present a valid, unused code is entitled to first entry, subject to verification of age or other eligibility.

4. The Purchaser should protect the code from disclosure to an unauthorised person. After first validation, the code is marked as used and the Participant receives a personal wristband for subsequent entry.

5. Admission, participation by minors, safety and conduct on the Festival Site are governed by the relevant event regulations.

6. An Additional Access Ticket may be purchased only by the holder of a valid Ticket covering the whole Festival. It entitles the holder only to enter and remain on the Festival Site during the precise hours stated in the Offer. It does not include the Festival programme, food, an allocated place or other services unless the Offer expressly states otherwise.

§ 8. Atelier Goods and future Optional Add-ons

1. The Offer for Goods states their main characteristics, price and availability and, where relevant, the variant, material, dimensions, estimated dispatch time and delivery restrictions.

2. Delivery methods for Goods, their cost and the estimated delivery date or period are stated before the Order is placed. The Goods are delivered within the period agreed with the Purchaser or, where no period has been agreed, within the period required by law.

3. In the case of a Consumer or Entrepreneur with Consumer Rights, the risk of loss of or damage to the Goods passes to the Purchaser on physical receipt, except where the Purchaser independently chose a carrier that was not offered by the Seller.

4. It is advisable to document any visible damage to a parcel on receipt. The absence of a damage report does not deprive a Consumer of rights relating to a lack of conformity with the Contract.

5. The Online Store may in future offer parking, glamping, a camper pitch or other Optional Add-ons. They are not part of a Standard Ticket.

6. Each Optional Add-on is offered as a separate service on its own product page. Before purchase, the Offer states its scope, place, date or period, price, availability, method of performance, cancellation terms and whether a right to withdraw applies.

7. The purchase of an Optional Add-on does not alter the scope of a Ticket unless the Offer expressly and lawfully states otherwise. If a combination of services is governed by mandatory special legislation, the Seller will comply with that legislation and provide the required information before the Contract is entered into.

§ 9. Right to withdraw from the Contract
1. Tickets and services provided on a specified date or during a specified period

1. A Consumer or Entrepreneur with Consumer Rights may not withdraw within fourteen days, without giving a reason, from a Contract for a Ticket to the Festival, a concert or another cultural or entertainment event or for an Additional Access Ticket where the Contract specifies the day or period of the service. This follows from Article 38(1)(12) of the Polish Consumer Rights Act.

2. A Ticket is not refundable because of a change in personal plans, cancellation by the Participant, late arrival or non-attendance. This does not limit the Purchaser’s rights where a service is not performed, the event is definitively cancelled or a material change is made.

3. The right to withdraw from each Optional Add-on is assessed according to the nature of that service and the relevant information is provided before purchase.

2. Goods

1. A Consumer or Entrepreneur with Consumer Rights may withdraw from a Contract for the sale of Goods within 14 days of taking possession of them. Where Goods are delivered separately, the period runs from receipt of the last item.

2. To meet the deadline, it is sufficient to send an unequivocal statement to hello@dreamersland.eu or the Seller’s registered office. The model form in the Appendix may be used, but this is not required.

3. The Goods must be sent back no later than 14 days after the statement is made. The Purchaser bears the direct cost of return unless stated otherwise before purchase.

4. The Seller refunds the payments received for the returned Goods, including the cost of the least expensive standard delivery method offered by the Online Store, no later than 14 days after receiving the statement. The Seller may withhold the refund until the Goods or evidence of their return has been received.

5. The Purchaser is liable for any reduction in the value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics and operation.

6. The right to withdraw does not apply in the cases listed in Article 38 of the Polish Consumer Rights Act, including Goods made to the Consumer’s specifications or serving their individual needs, where the conditions for the exception are met and the Purchaser was informed before purchase.

§ 10. Conformity with the Contract and complaints

1. The Seller delivers Goods and performs services in conformity with the Contract. The rights of a Consumer and Entrepreneur with Consumer Rights where Goods do not conform to the Contract are governed by the Polish Consumer Rights Act.

2. A complaint concerning Goods, a Ticket, payment, performance of a service or operation of the Online Store may be sent to hello@dreamersland.eu or submitted in writing to the Seller’s registered office.

3. It is helpful to provide contact details for the reply, the Order number, a description of the problem, the date it was identified and the remedy requested. Missing information that is not required by law will not cause the complaint to be rejected.

4. A problem that can be resolved during the Festival should be reported promptly at the information point. This does not limit the right to make a later complaint.

5. The Seller will reply to a complaint from a Consumer or Entrepreneur with Consumer Rights within 14 days of receiving it, on paper or another Durable Medium.

6. These Terms do not limit rights arising from mandatory law.

§ 11. Ticket validity when an event changes

1. A decision by the Purchaser or Participant not to attend, their absence or any other circumstance attributable solely to either of them does not give rise to a right to a refund, exchange or transfer of the Ticket to another event.

2. If, because of Force Majeure, a binding authority decision or an objective safety threat, the event cannot lawfully and safely take place at its original time, place or within its original scope, the organiser may make a necessary and proportionate change. The Ticket remains valid at the replacement time or place for the corresponding scope of service, without exchange or additional payment.

3. Where the change to the date, venue or scope is material, the Purchaser may accept it or reject it and request a refund of the amount paid for the unperformed service. The Purchaser will receive information about the change, the available options and the decision period on a Durable Medium.

4. Where there is a material change, the organiser may additionally offer a voluntary transfer of the Ticket to the next edition without any additional payment solely because the later edition is priced higher, or a Dreamersland Balance that may be used for one or more Tickets in available exchange pools. Before making a choice, the Purchaser will receive the terms of the solution on a Durable Medium, including the Balance validity period and the treatment of any unused amount. The choice requires the Purchaser’s express statement.

5. If the service is not performed, the Seller settles the unperformed part in accordance with mandatory law. In the event of definitive cancellation without a replacement time or place, the Seller refunds the amount paid for the unperformed service unless the Purchaser has previously selected another lawful solution. Within the limits of the law, Force Majeure may exclude liability for further loss not caused by the Seller, but does not exclude settlement of the unperformed service.

§ 12. Intellectual property rights and Website materials

1. The Website, its names, signs, layout, text, photographs, graphics, recordings and other content may be protected by rights belonging to the Seller or other persons.

2. Users may use Website content for their own purposes and within the limits permitted by law. Purchasing Goods bearing the Dreamersland brand does not transfer copyright or grant a licence beyond ordinary use of the Goods.

3. Without the rights holder’s permission, Website content must not be commercially exploited, published, modified, copied in bulk or used to create datasets or train models. Dreamersland signs must not be used in a way that suggests an official partnership or patronage.

4. These Terms do not restrict permitted use or other rights arising from mandatory law.

§ 13. Personal data and cookies

1. As a rule, the controller of data processed in connection with the Website, Online Store and Contract is DREAMERSLAND sp. z o.o.

2. Detailed information about purposes, legal bases, recipients, retention periods, individual rights and cookies is provided in the Dreamersland Privacy and Cookies Policy. A notice displayed with a particular Form may supplement that Policy.

3. A document confirming disability is viewed solely to verify eligibility. It is not copied or recorded, and the Seller does not retain the health data it contains.

4. Purchasing a Ticket is not consent to unrestricted use of the Purchaser’s or Participant’s individual image, voice or statement. Recording of events is governed by the relevant regulations and the Dreamersland Privacy and Cookies Policy.

§ 14. Website availability and liability

1. The Seller takes care of the Website’s security and proper operation but does not guarantee uninterrupted availability of every function. The Website may be temporarily unavailable because of maintenance, a failure, actions or outages affecting infrastructure providers, a security risk or an event beyond the Seller’s reasonable control.

2. The Seller may restrict access to a function or content, or apply additional safeguards, where necessary to comply with the law, protect security or stop misuse. This does not limit its obligation to perform a Contract already entered into.

3. The Seller’s liability is governed by applicable law. These Terms do not exclude liability that cannot lawfully be excluded, in particular liability for personal injury, wilful misconduct or gross negligence.

4. The Purchaser is responsible for the accuracy of information provided, protection of access to the account and Ticket code, and lawful use of the Website and Online Store.

§ 15. Disputes, amendments and final provisions

1. After the complaint process has been exhausted, a Consumer may seek assistance from the Polish Trade Inspection, a permanent consumer arbitration court or a municipal or district consumer ombudsman. Information about procedures is available at https://polubowne.uokik.gov.pl. This does not exclude the right to bring proceedings before a court.

2. The Seller may amend these Terms for a valid reason, in particular a change in the law, the Seller’s details, the Website’s functions or safeguards, payment or delivery methods, the introduction of a new product type, or the need to correct an error or prevent misuse.

3. An amendment does not affect acquired rights or alter an existing Contract to the Purchaser’s detriment unless required by law. A User of an ongoing service affected by an amendment will receive reasonable advance notice and may end the service before the amendment takes effect. Advance notice is not required where law or urgent security needs require an immediate change.

4. These Terms are governed by Polish law. This does not deprive a Consumer of the protection granted by mandatory provisions of the country of their habitual residence. Disputes will be decided by the court having jurisdiction under applicable law.

5. Matters not covered by these Terms are governed by applicable law, in particular the Polish Civil Code, Consumer Rights Act and legislation on services provided electronically. A specific document concerning an event or programme takes precedence within its scope.

6. If one provision is invalid, the remaining provisions continue to apply.

7. The English version communicates the same content. In the event of a discrepancy, the Polish version is the point of reference to the extent permitted by law.

8. These Terms take effect on the date they are published on the Website. A Contract entered into earlier is governed by the version provided to the Purchaser at the time of purchase.
